I just spent about half an hour reading the Trump team's appeal of their absolute benchslap in M.D. Pa., and the original decision by Judge Brann, and hoooo boy do the Trump team have some incredibly shitty lawyers. I don't even do appellate advocacy and I'm wincing with every new document I read. It's just so fuckin incompetent. There are talented and evil lawyers out there that could spin together a meaningful-if-convoluted claim that could survive to SCOTUS cert review, but they're not touching this with a 20-foot dildo in the odd event that it singularly destroys the legitimacy of the court system that butters their bread. Nobody competent wants to upset the applecart.

I think there have been multiple substitutions of counsel in every case where Trump is actually a named plaintiff and not just an ultimately interested party, a sure sign that things are going swimmingly

The problem is that the petitioners misunderstand the nature of state constitutions: actions not forbidden in state constitutions are presumptively constitutional—as opposed to the federal constitution, which requires that legislation derive from a specific grant of power. The cleanest analogy I can think of: the US Constitution is a circuit board, with only specific spots sufficient to create a circuit; state constitutions are a metal plate with tiny rubber discs on it.
The section of the PA constitutions they cite is mandatory but not limiting: “the Legislature shall,” not “the Legislature shall only.” This means the legislature rolling back those prescribed standards for absentee voting (illness, absence, etc.) would be unconstitutional, not necessarily that expanding it would be.
No law schools I’m aware of require state/local law coursework—which explains how dumb this particular complaint is. Also, that article does a really bad job at explaining what “likelihood of success on the merits” actually means—that is, it’s a threshold question, and a pretty low one at that. It doesn’t tip the hand of likelihood at winning overall, just that there is a bona fide controversy. It’s still a loser of an argument, though.
