There's not much incentive for politicization within the PTO and among the TTAB. This was decided using a standard affirmed by the D.C. Federal Appellate Circuit, which has exclusive jurisdiction over all administrative agency appeals. A contrary decision would've been reversed on appeal, unless the appellate court overturned the current law.
